JUSTICE MRIDUL KUMAR KALITA ORDER Date : 07.04.2026 1. Heard Mr. A. B. Dey, the learned counsel for the applicants. Also heard Ms. R. D. Mazumdar, the learned counsel for the opposite party No. 1/Insurance Company. 2. This Interlocutory Application has been filed by the applicants/claimants praying for allowing the applicants to withdraw the Page No.# 4/4 50% of the compensation amount, which has been deposited by the Insurance Company in pursuant to the order dated 03.11.2025 passed in I.A. (Civil)/3495/2025. 3. The learned counsel for the applicants has submitted that the applicants are ready to furnish the indemnity bond, if such condition is imposed for withdrawing the aforesaid amount. 4. On the other hand, the learned counsel for the Insurance Company submits that though, she had some objection to the prayer for withdrawal, however, in the event a condition is imposed on them to file an indemnity bond in case of such withdrawal she does not have any objection for the same. 5. Considering the submissions made by the learned counsel for both sides, this Interlocutory Application is allowed. 6. The Registry is directed to disburse the 50% of the awarded amount, which has already been deposited before the Registry by the Insurance Company in pursuant to the order dated 03.11.2025 passed in I.A. (Civil) No. 3495/2025 after proper verification and subject to furnish an indemnity bond of Rs. 13,02,500/- as such an undertaking therein that in the event the connected appeal is allowed and the applicants are required to deposit the said amount, they will do so. 7.
