The present writ petition has been filed seeking a direction to the respondent/Tata Power Delhi Distribution Ltd. to restore the electricity supply of the petitioner’s residential premises. A further direction is sought for quashing the Speaking Order dated 26th December, 2025 and all consequential actions emanating therefrom, including Disconnection Notice dated 11th January, 2026, Assessment Bill dated 26th December, 2025 and a Bill of Supply dated 1st January, 2026. 2. A Speaking Order under Section 135 of the Electricity Act, 2003 has been passed by the respondent on 26th December, 2025. The conclusion as recorded in the said order is set out below: This is a digitally signed order. Pursuant to the aforesaid speaking order, a bill was raised by the respondent, claiming an amount of Rs.46,128/- towards arrears from the petitioner. Since the petitioner failed to pay the said amount, the electricity connection was disconnected. 4. Aggrieved by the Disconnection Notice and the false allegation of theft of electricity, the petitioner had earlier filed a civil suit before the District Judge being CS DJ 43/2026. The application for interim stay was rejected by the District Judge. Subsequently, the plaint was returned under Order VII Rule 10 of the Code of Civil Procedure, 1908 (‘CPC’) on account of lack of pecuniary jurisdiction. 5. Mr. Manish Srivastava, counsel appearing on behalf of the respondent submits that respondent would be agreeable to restore the electricity This is a digitally signed order. Accordingly, the present writ petition is disposed of while directing that subject to the petitioner paying the aforesaid amount of Rs.46,128/- towards arrears, the electricity connection of the petitioner would be restored. Upon restoration, the petitioner would continue to pay consumption charges on an ongoing basis. 7. The aforesaid amount shall be paid by petitioner without prejudice to his rights and contentions and the petitioner would have the liberty to challenge the same in appropriate proceedings available in law.
