That, appellant No.2,3,4 and 5 are children of appellant No.1, they may be treated as legal representatives of appellant No.1 in the interest of justice and equity.” 2. Placing the memo on record, at the risk of the appellants, no further orders are necessary in respect of deceased appellant No.1. 3. Appellant Nos.2 to 5 and respondent Nos.1 and 2 are present before the Court. 4. A compromise petition under Order XXIII Rule 3 of the Code of Civil Procedure is filed, signed by the parties and their respective advocates. 5. Parties agree that contents of the compromise petition depict true terms of settlement and there is no force, undue influence or coercion in reaching out the terms of the settlement. 7. As such, there is no impediment for this Court to accept the compromise petition and pass modified decree. 8. Hence, the following: ORDER (i) Appeal stands allowed in terms of the compromise petition. (ii) Office is directed to pass modified decree in terms of the compromise petition appending copy of the compromise petition as part of the decree. (iii) No order as to costs.
