The present petition has been filed by the petitioner under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘B.N.S.S.’) with the following relief:- “It is therefore, prayed that this Hon'ble Court may allow the petition and also be pleased to Quash the F.I.R. bearing Crime No. 663/2025 registered at Police Station: Civil lines, District Raipur (C.G.) dated 16.12.2025 against the Petitioner for the offences punishable under Sections 319(2), 336(3), 340(2), 351(3) of the BNS, 2023 and, along with all consequent proceedings (if any) incidental & accidental thereto.” 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in connection with Crime No. 663/2025 registered at Police Station Civil Lines, District Raipur, for the offences punishable under Sections 319(2), 336(3), 340(2) and 351(3) of the Bharatiya Nyaya Sanhita, 2023. He submits that the petitioner was not named in the FIR and that the allegations are based solely on an alleged telephonic conversation from mobile number 7869455712, wherein the caller is alleged to have impersonated himself as Ravi Mishra, OSD to the Hon’ble Chief Minister. It is contended that the FIR does not disclose any specific or credible material establishing the petitioner’s involvement in the alleged offences and, therefore, continuation of the criminal proceedings against him would amount to an abuse of the process of law. He further submits that the FIR was registered on 16.12.2025 and the petitioner was enlarged on regular 3 bail by the learned Chief Judicial Magistrate, Raipur, on 22.12.2025, considering the facts and circumstances of the case and the absence of objection from the complainant. It is also submitted that, despite lapse of considerable time, no final report under Section 193 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed before the competent Court. In the aforesaid circumstances, learned counsel submits that the allegations contained in the FIR, even if taken at their face value, do not make out the alleged offences against the petitioner and continuation of the investigation/proceedings would serve no fruitful purpose. He, therefore, prays that the FIR bearing Crime No. 663/2025 and all consequential proceedings arising therefrom be quashed. 4. Per contra, learned State counsel, while opposing the petition, submits that the FIR discloses specific allegations against the petitioner, who is alleged to have impersonated himself as OSD to the Hon’ble Chief Minister and threatened the complainant over the telephone. It is submitted that the allegations are subject matter of investigation and the mere fact that the petitioner was not named in the FIR or that the final report has not yet been filed cannot be a ground for quashing the FIR at the threshold. He, therefore, submits that the petition, being devoid of merit, deserves to be dismissed. 5. We have heard learned counsel for the parties and have carefully perused the material available on record. 6. At the outset, it is relevant to note that the petitioner has already been enlarged on anticipatory bail. Having regard to the nature of the 4 relief sought in the present petition and the fact that the investigation is still pending, we are of the considered view that the present petition can be disposed of without entering into the merits of the allegations or expressing any opinion on the merits of the case. 7. Accordingly, the present petition is disposed of with a direction to the Investigating Officer to conclude the investigation in connection with Crime No. 663/2025 registered at Police Station Civil Lines, District Raipur, strictly in accordance with law, as expeditiously as possible, preferably within a period of four weeks from the date of receipt of a certified copy of this order. 8. It is made clear that this Court has not expressed any opinion on the merits of the allegations, the applicability of the offences alleged, or the defence of the petitioner, and the Investigating Officer shall proceed with the investigation independently and in accordance with law. 9.
