JUSTICE MITALI THAKURIA ORDER 13-02-2026 Heard Mr. S. Ahmed, learned counsel for the petitioners and Mr. B. Sarma, learned Additional Public Prosecutor, for the State respondent. 2. This is an application under Section 482 BNSS, 2023 praying for grant of pre-arrest bail to the accused/petitioners, namely, (i) Momina Begum @ Khatun; (ii) Abu Sahed; (iii) Khairul Islam; (iv) Jakam Ali @ Zakaria Ahmed; (v) Nijamul Islam @ Hoque; (vi) Rashidul Islam; (vii) Tajmul Islam @ Hoque; (viii) Wafija Begum @ Ozifa Khatun and (ix) Romjina Begum who are apprehending arrest in connection with Dhing P.S. Case No. 238/2025 under Sections 191(2)/191(3)/329(3)/117(2)/118(2)/109 of BNS, 2023. 3. During the deliberation of the matter, Mr. Sarma, learned Additional Public Prosecutor, Assam, on instruction, submitted that police after completion of investigation of the case has already submitted the charge-sheet in said Dhing P.S. Case No. 238/2025 vide Charge-Sheet No. 270/2025 dated 29.11.2025. 4. In view of the above, all the petitioners are hereby directed to approach the Page No.# 3/3 learned Trial Court for their regular bail in said Dhing P.S. Case No. 238/2025 within a period of 15 (fifteen) days from today, which may be considered in accordance with law. 5. The interim bail granted to the petitioner No. (i), namely, Momina Begum @ Khatun and petitioner No. (ii), namely, Abu Sahed earlier on 18.12.2025 in said Dhing P.S. Case No. 238/2025 shall remain in force for the next 15 (fifteen) days. 6. In the event, the petitioner Nos. (i) and (ii) fails to appear before the learned Trial Court seeking regular bail, within the period of 15 (fifteen) days, the interim bail granted to them shall stands cancelled. 7.
