Petitioner has preferred this writ petition (civil) under Article 226 of the Constitution of India seeking following reliefs :- 10.1 That, this Hon'ble Court kindly be pleased to issue writ/order/direction towards the respondent authority to remove the encroachment made by respondent No.5 on the 0.02 Hec. of the land bearing Khasra No. 3389 raqba 0.0121 hec., in the larger interest of justice. 10.2 That, this Hon'ble Court kindly be pleased to issue appropriate writ/order/direction to the respondent authority Digitally signed by AVANISH KUMAR PATHAK Date: 2026.01.27 17:09:40 +0530 2 to pay appropriate compensation for the delay caused and harassment done, in the larger interest of justice. 10.3 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner together with cost of the petition. 2. Learned counsel for the petitioner would submit that, vide order dated 27-9-2021 (Annexure P-3) passed by the Tahsildar, Shivarinarayan, private respondent No. 5 was held to be encroacher of government land area 0.002 hectare of total land 0.121 hectare of Khasra No. 3389 of village Salkhan. He has also been directed to be evicted from aforesaid land by imposing cost. The appeal preferred by him before the Sub Divisional Officer (Revenue) Janjgir, Distt. Janjgir has also been dismissed vide order dated 4-2-2022 (Annexure P-4), despite that, the order dated 27-9-2021 (Annexure P-3) has not been complied with, therefore, learned counsel for the petitioner would submit that, this petition may be disposed of directing the respondent authorities to ensure compliance of the above order. 3. In reply, learned State Counsel submits that, eviction proceeding against respondent No. 5 is going on. Since despite service of notice, he did not vacate the land, proceeding has been initiated to send him to civil jail, but respondent No. 5 has given undertaking that he will vacate the said portion of land. 4. Since the order to be complied with was passed on 27-9-2021, despite that, the same has not been complied with, hence, respondent authorities are directed to comply with the order (annexure P-3) as early as possible without any undue delay. 5.
