Petitioner prays for direction upon the concerned police authorities to take certain steps in accordance with law taking note of the complaint lodged. 3. Learned advocate representing the State respondents has filed a communication dated 23rd July, 2026 of Inspector-in-Charge, Madhyamgram Police Station, Barasat Police District and same is taken on record. Copy of the said communication dated 23rd July, 2026 is made over to the learned advocate representing the petitioner. 4. It is disclosed in the said communication that based on the complaint lodged by the petitioner on 25th May, 2025 a criminal prosecution being Madhyamgram Police Station Case No. 378/2025 dated 25th May, 2025 was initiated and same culminated into filing of charge- sheet dated 30th June, 2025. However, it is also 2 submitted on behalf of the petitioner that subsequent complaint dated 13th January, 2026 did not yield any result and no steps have been taken by the concerned police authorities. 5. If petitioner is dissatisfied with the inaction on the part of the concerned police authorities in connection with petitioner’s complaint dated 13th January, 2026, in that event petitioner needs to approach jurisdictional magistrate under Section 175(3) BNSS, 2023. In this regard reliance is placed on the judgment of the Hon’ble Supreme Court reported in (2007) 6 SCC 171, Aleque Padamsee & Ors. vs. Union Of India & Ors. 6. However, criminal proceeding initiated based on previous complaint of the petitioner dated 25th May, 2025 culminates into filing of charge-sheet. Hence, no further order need be passed in this writ petition and the writ petition stands disposed of. 7.
