28.07.2026 Court No.35. D/L. 5. Kausik (Rejected) CRM (M) 1018 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chandannagar Cyber Crime Police Station Case No. 30 of 2024 dated 14.11.2024 under Section 318(4)/316(2)/317(4)/61(2) of BNS, 2023 and Section 66/66D of Information Technology Act, 2000. And In the matter of : Golam Mustafa ……Petitioner. Mr. Milon Mukherjee, Sr. Adv. Mr. Bitasok Banerjee Ms. Debangana Bhattacharya ……for the Petitioner. Mr. Kallol Mondal, PP Mr. Subrata Mukherjee Mr. Mayukh Mukherjee Mr. Sanjib Das ……for the State. Learned Senior Advocate appearing for the petitioner refers to the earlier order when there was a direction by this Court to complete 5 vital witnesses by 31.03.2026. The earlier order in CRM(M) 2027 of 2025 reflects, prosecution would rely upon 23 witnesses to prove its case. Learned Public Prosecutor reiterates that the witnesses have been reduced in this case. It has been informed by the petitioner that 3 of the witnesses till date have been examined completely and the examination-in-chief of 5 witnesses have been completed. 2 Having considered that the petitioner is in custody for 1 year and 8 months and the cross-examination of the 5 witnesses are left, at this stage, I am not inclined to release the petitioner on bail. Petitioner would renew his prayer for bail after the cross-examination of the said witnesses are completed. With the aforesaid observations CRM (M) 1018 of 2026 is dismissed at this stage. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
