The petitioner is apprehending his arrest in connection with Pandwa P.S. Case No. 25 of 2023, registered for the offence under Sections 147, 148, 149, 341, 323, 325, 307, 364 and 120-B of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj. 3. Learned counsel appearing for the petitioner submits that the petitioner has purchased a second hand Scorpio vehicle bearing registration No. DL-8-CAC-1327 in the year 2022, which was earlier registered in the name of Joginder Singh from Delhi. She next submits that the petitioner has purchased the said vehicle for his own use, however, since the petitioner hails from a village and the nearby villagers as and when they asked for the vehicle, the same is being given to the known person on pro-bono basis. She further submits that one Ritik Kumar along with others have requested the petitioner for the said vehicle to go to Daltonaganj to play cricket match and thereafter the said vehicle has been misutilized for doing the alleged crime. She [2026:JHHC:9811] -2- also submits that the petitioner came to know about the present case, when a notice under Section 35(3) Bharatiya Nagarik Suraksha Sanhita, 2023 has been received by him. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the owner of the vehicle in question. 5. Considering that the vehicle in question was handed over to one Ritik Kumar, who has taken the said vehicle to go to Daltonganj to play cricket match and thereafter the vehicle was misutilized, in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
