1. At the very outset, learned counsel for the petitioner would submit that the petitioner is entitled for promotion to the post of Assistant Engineer under respondent No. 3 after completion of five years of service. He would contend that the juniors of the petitioner were promoted to the post of Assistant Engineer vide order dated 31.07.2021, whereas name of the petitioner was considered for promotion on 30.12.2022. He would further contend that the petitioner was entitled for promotion, seniority, and consequential benefits attached to the post from the date on which his juniors were promoted, i.e., 31.07.2021. 2.
On the other hand, learned counsel appearing for the respondents would oppose the submission made by counsel for the petitioner and contend that the probation period of the petitioner came to an end on 03.09.2021, whereas the DPC was convened for promotion from the post of Junior Engineer to Assistant Engineer on 31.07.2021, therefore, the name of the petitioner was not considered. He would submit that after completion of probation period of the petitioner, immediately thereafter, the name of the petitioner was considered for promotion and order was also issued; thus, the petition deserves to be dismissed. 3. Having considered the facts stated above, without commenting on the merits of the case, the petitioner is permitted to make a representation before respondent No. 3 claiming seniority, promotion, and other consequential benefits at par with his juniors from the date on which they were promoted, within a period of 90 days. 5. With the aforesaid observation(s) and direction(s), this writ petition is hereby disposed of. No order as to cost(s). Sd/-
