ORAL ORDER
1. Accused in Crime No.201/2026 registered by K. R. Puram Police Station, Bengaluru, for the offences punishable under Sections 64, 69, 89, 351(2), 351(3) read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Amicus Curie for the petitioner and the learned Addl. SPP for respondent - State. 3. FIR in Crime No.201/2026 was registered by K. R. Puram Police Station, Bengaluru, for the aforesaid offences against petitioner and two others based on the first information dated 25.03.2026, received from the victim girl aged 19 years. During the course of investigation of the said case, petitioner was arrested on 27.03.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.3155/2026 was rejected on 24.04.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that petitioner and the victim are classmates pursuing their first year BCA.
It appears that they are acquainted for the last 3 to 4 years and they are in love. Petitioner and the victim had consensual sexual

intercourse and as a result, victim got pregnant. Subsequently, her pregnancy was aborted in a Hospital. In the first information, it is alleged that petitioner had promised to marry the victim girl and it is under these circumstances, she had agreed to have sex with him. It is alleged that petitioner had subsequently refused to marry her. It is under these circumstances, FIR was registered against the petitioner and his relatives. 5. In the statement of the victim, that was recorded under Section 183 of BNSS, 2023, before the jurisdictional Magistrate, she has stated that she and the petitioner are in love for the last 3 years and they had consensual sex and as a result, she became pregnant. She had gone to the Hospital and got the pregnancy aborted. She has stated that prior to registration of the FIR, petitioner had fought with her and therefore, she got angry and had filed a complaint against him. Investigation of the case is now completed and charge sheet has been filed. It is not in dispute that petitioner, who is a student aged 19 years, has no other criminal antecedents. Considering the aforesaid aspects of the matter and also the statement of the victim girl recorded under Section 183 of BNSS, 2023, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:-

6. The petition is allowed.
The petitioner is directed to be enlarged on bail in Crime No.201/2026 registered by K. R. Puram Police Station, Bengaluru, for the offences punishable under Sections 64, 69, 89, 351(2), 351(3) read with Section 3(5) of BNS, 2023, subject to the following conditions:
a) Petitioner shall execute a personal bond for a sum of Rs.50,000/- with one surety for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
7. The services of learned Amicus Curiae is placed on record and his fees is fixed at Rs.15,000/-. 8. Registry is directed to forthwith forward a copy of this order to the Committal Court/Trial Court. Sd/- (S VISHWAJITH SHETTY) JUDGE DN/List No.: 1 Sl No.: 37
