Ms. Manisha Dutta … for the petitioner Mr. Sudipto Kumar Majumdar, DSGI Mr. Tridip Saha … for respondents The petitioner claims that her son Bijoy Chakraborty, who was working in the departmental canteen stores at Bagdora under the Ministry of Defence, died intestate on February 6, 2003. The petitioner alleges that the wife of Late Bijoy Chakraborty has left the matrimonial home on her own will after the death of the petitioner’s son and she has remarried. Petitioner submitted several representations before the respondent authorities requesting the authorities to disburse the retiremental benefits including pension in favour of the petitioner. 2 Learned advocate appearing for the petitioner submits that the petitioner submitted a representation dated April 30, 2026 requesting the respondent authorities to disburse the persnionery and other retiremental benefits arising out of the service of her son to her. He submits that no decision has been communicated to the petitioner in spite of the fact that the petitioner has submitted several representations and the last of such representation is dated April 30, 2026. Learned advocate appearing for the respondents submits that the decision on such representation shall be communicated to the petitioner within the time limit as may be fixed by this Court. Without entering into the merits of the claim made by the petitioner in the representation dated April 30, 2026 this writ petition stands disposed of by directing the Area Manager, Department Canteen Stores, Government of India, Ministry of Defence, Bagdogra, Darjeeling, being the 2nd respondent, to consider the representation of the petitioner dated April 3 30, 2026 and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner and any other person who may be affected by such decision and communicate the reasoned order to the respective parties as expeditiously as possible, but positively within a period of six weeks from the receipt of a server copy of this order together with a copy of the representation dated April 30, 2026.
