Sukla Chowdhury Vs. The State of West Bengal & Ors.
Ms. Taniya Bhoumik … for the petitioner Mr. Alok Sah Mr. Tuhin Kumar Roy … for the State
Affidavit-of-service filed in Court today be kept with the record. The husband of the petitioner was an Assistant Teacher of Shalmara No. 3 Primary School, who died on December 16, 2020. The pension payment order was issued on April 13, 2006 in pursuance whereof the gratuity and family pension was received on September 26,
2006. In the instant writ petition the petitioner prayed that a writ of Mandamus be issued commanding the respondents to pay interest on the said amount of family pension for delayed payment.
2 Learned advocate for the State respondents does not oppose the prayer of the petitioner. It is now well settled that the petitioner is entitled to the interest, as prayed for. In view thereof, this writ petition is disposed of by directing the concerned Treasury Officer, Cooch Behar - I being the respondent no. 3 to pay interest to the petitioner @ 8% per annum on the gratuity and family pension from the date following the date of death of the husband of the petitioner till the date of such payment. The payment as aforesaid shall be made within the period of eight weeks from the date of communication of this order; in default, the said amount shall fetch an additional interest of 2% per annum. Since no affidavits have been called for, the allegations contained in the writ petition shall be deemed not have been admitted by the respondents. There shall be no order as to costs. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, upon compliance of requisite formalities.
