Affidavit of service filed in Court is taken on record. The grievance of the petitioner is that his prayer for re-option under ROPA, 2019 is pending since January, 2020. Mr. Mallik, learned advocate appearing for the petitioner submits that the petitioner by a letter dated January 27, 2020 requested the concerned District Inspector of Schools (S.E.) to consider the prayer of the petitioner for change of the date of option from January 1, 2016 to July 25, 2019. He submits that though a long time has elapsed since the receipt of such representation, no decision on the prayer of the petitioner has been communicated to him till date. 2
The learned advocate appearing for the State submits that the matter is now pending before the Commissioner of School Education. The written instruction of the District Inspector of Schools (S.E.) dated July 17, 2026 filed by the learned advocate for the State is taken on record. In the light of the submissions made by the learned advocate for the respective parties, WPA 1162 of 2026 stands disposed of by directing the Commissioner of School Education, Government of West Bengal, being the respondent no.4 to consider the representation of the petitioner dated January 27, 2020 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representatives and communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed as expeditiously as possible but positively within a period of 6 weeks from the receipt of server copy of this order together with a copy of the representation dated January 27,
2020. It is, however, made clear that this Court has not entered into the merits of the claim made by the petitioner in the representation and all points are left open to be decided by the said authority in accordance with law. 3
There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
