Affidavit-of-service filed in Court today, is taken on record. 2. The petitioner prays for pre-arrest bail in connection with Samuktala Police Station Case No.303 of 2008 dated 17.06.2008 under Sections 493/376/314/325 of the Indian Penal Code. 3. The learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. 4. The alleged incident is of 2008 and the complaint was lodged on June 17, 2008. The investigation was completed in 2024. From the contents of the complaint filed before the police by the victim, it appears that the parties were involved in a love relationship for about 7 years. The allegation is that the victim got pregnant, but had to abort the child at the insistence of the petitioner. Thereafter, the petitioner refused to marry the victim despite a prolonged love affair. 2 5. Considering the materials in the case diary and the fact that the investigation is over, this Court is of the view that custodial interrogation of the petitioner is not necessary. 6. Accordingly, I direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/-, with two sureties of like amount each, one of whom must be local to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 438(2) of the Code of Criminal Procedure. The further condition is that the petitioner will appear before the jurisdictional court as and when dates are being fixed as it is informed that charge is yet to be framed. The petitioner shall not leave the jurisdiction of Samuktala police station except for the purpose of attending the court. 7. In case the petitioner fails to adhere to any of the conditions as stated above, anticipatory bail stands automatically cancelled without further reference to this Court. 8. The application for anticipatory bail, being CRM (A) 517 of 2026 is allowed and disposed of. 9. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Shampa Sarkar, J.)
