Mr. Kalipada Das Ms. Saheli Roy Sarkar ….for the petitioner Ms. Supriya Singh Mr. Bibek Tarafder ….for the State Ms. Disha Sanyal Mr. Snehasish Barman ….for the respondent no.2 The petitioner claims to be the first wife of one Nityaranjan Saha, who retired while serving as a Beat Officer under the respondent authority. The petitioner claims that her husband was receiving pension and he died on September 29, 2024. The petitioner submitted a representation before various authorities including the Chief Conservator of Forests, Personnel Management Cell, being the respondent no.6 praying for release of family pension in her favour. The learned advocate appearing for the petitioner submits that in spite of receipt of such representation, no decision on such representation has been communicated to the petitioner till date. 2 The learned advocate appearing for the respondent no.2 submits that the respondent no.2 is the first wife of the said Nityaranjan Saha and she is entitled to the family pension and the petitioner is not entitled to family pension. The learned advocate appearing for the respondent no.2 further submits that the petitioner herein has filed a suit being Title Suit No.195 of 2025 before the Civil Judge (Jr. Div.), Alipurduar, praying for declaration that she is the married wife of the deceased Nityaranjan Saha and for a further declaration she is entitled to get share in death benefits and family pension in respect of her deceased husband. Since a civil suit is pending between the private parties wherein the respondent authorities have also been impleaded as defendants, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition stands dismissed as non-entertained. Petitioner is left free to proceed with the Title Suit No.195 of 2025 before the civil court in accordance with law.
