1 CWP-21080-2026 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 130 CWP-21080-2026 Date of Decision: 14.07.2026 VIKRAM SINGH .....Petitioner VERSUS STATE OF HARYANA AND ANR ..Respondents CORAM: HON'BLE MR. JUSTICE HARPREET SINGH BRAR Present : Ms. Megha Nanot, Advocate and Mr. Raman Sihag, Advocate for the petitioner. Mr. Naveen Singh Panwar, DAG Haryana. **** HARPREET SINGH BRAR , J. (Oral) 1. The present Civil Writ Petition has been filed under Articles 226 and 227 of the Constitution of India seeking issuance of an appropriate writ, order, or direction in the nature of mandamus directing the respondent- Education Department to consider the claim of the petitioner for promotion to the post of Social Studies Master/TGT w.e.f. the date his juniors were promoted vide order dated 12.12.2010 (Annexure P-3). A further direction is sought to the respondents to fix the seniority of the petitioner from the year 2010 in accordance with the Haryana State Education School Cadre (Group-C) Service Rules, 1998 and the Haryana School Education . PARUL VERMA 2026.07.15 15:02 I attest to the accuracy and authenticity of this order/judgment. 2 CWP-21080-2026 (Group-C) Service Rules, 2012, and to grant all consequential benefits arising therefrom, including fixation of pay, seniority, and other attendant service benefits. The petitioner also seeks a direction to the respondents to consider and decide his representation dated 20.05.2026 (Annexure P-5) by passing a reasoned and speaking order. 2. Learned counsel for the petitioner, inter alia, contends that the petitioner was appointed as a JBT Teacher on 06.10.2000 (Annexure P-1) and possesses an unblemished service record with no disciplinary proceedings ever having been initiated against him. It is contended that the petitioner was fully eligible for promotion to the post of Social Studies Master under the Haryana State Education School Cadre (Group-C) Service Rules, 1998 (Annexure P-2). However, vide order dated 12.12.2010 (Annexure P-3), the respondents promoted several JBT Teachers, who were admittedly junior to the petitioner, without considering his claim for promotion. 2.1. Learned counsel further submits that despite repeated recommendations made by the competent authorities and the petitioner's representation dated 20.05.2026 (Annexure P-5), no decision has been taken by the respondents. It is argued that the controversy involved in the present petition is squarely covered by the judgment of this Court dated 17.09.2025 passed in CWP No.25983 of 2025 (Annexure P-6), and, therefore, the petitioner is entitled to the same relief. . PARUL VERMA 2026.07.15 15:02 I attest to the accuracy and authenticity of this order/judgment. 3 CWP-21080-2026 2.2. At this stage, learned counsel for the petitioner submits that he would be satisfied if the representation dated 20.05.2026 (Annexure P-5) of the petitioner is decided by the respondent No.2/competent authority in light of Anneuxre P-6 by passing a speaking order in a time bound manner. 3. Notice of motion. 4. Mr. Naveen Singh Panwar, learned DAG, Haryana, appears and accepts notice on behalf of the respondent-State. He opposes the prayer made by learned counsel for the petitioner on the ground that, as per the pleadings in the writ petition, the cause of action arose on 12.12.2010. It is submitted that the settled seniority cannot be unsettled after a lapse of more than thirteen years, in view of the judgment of the Hon'ble Supreme Court in B.S. Bajwa v. State of Punjab 1997 INSC 807, wherein it has been held that issues relating to seniority ought not to be reopened after the expiry of a reasonable period. However, learned State counsel submits that he has no objection if a direction is issued to respondent No.2/the competent authority to consider and decide the petitioner's representation dated 20.05.2026 (Annexure P-5) by passing a reasoned and speaking order within a stipulated time. 5. Therefore, in view of the limited prayer made by learned counsel for the petitioner and without commenting upon the merits of the case, the respondent No.2/competent authority is directed to consider the representation dated 20.05.2026, Annexure P-5, of the petitioner in light of . PARUL VERMA 2026.07.15 15:02 I attest to the accuracy and authenticity of this order/judgment. 4 CWP-21080-2026 Anneuxre P-6, after affording him an opportunity to be heard, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by the respondent. 6. Disposed of, accordingly. (HARPREET SINGH BRAR) JUDGE 14.07.2026 parul verma Whether speaking/reasoned. : Yes/No Whether Reportable. : Yes/No . PARUL VERMA 2026.07.15 15:02 I attest to the accuracy and authenticity of this order/judgment.
