The petitioner has been made accused in connection with Bishnugarh P.S. Case No. 18 of 2026 registered for the offences punishable under Sections 338, 336(3), 340(2), 318(4), 274, 275, 125, 61(2) of B.N.S., 2023 and Sections 47(a), 47(e), 52 and 55 of the Excise Act. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was driver of a pick-up van which was involved in transportation of huge amount of illicit foreign liquor bottles illegally. It is next submitted that the allegation against the petitioner is false. It is then submitted that petitioner has no concern with the seized liquor transported in his vehicle and he was the mere driver. It is then submitted that the petitioner has been in custody since 31.01.2026 as mentioned in para-22 of the instant bail application. It is lastly submitted that the petitioner undertakes to co-operate with the trial of the case and also undertakes not to annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be released on bail. It is next submitted that the co-accused with similar allegations has already been admitted to bail by this court vide order dated 06.04.2026 passed in B.A. no. 2770 of 2026 hence, the petitioner may be admitted to regular bail. Learned Addl. P.P. opposed the prayer for regular bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Hazaribagh in connection with Bishnugarh P.S. Case No. 18 of 2026 with the condition that the petitioner will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change the mobile phone number during the trial of the case.
