ORAL ORDER
1. Accused in Special Case No.209 of 2025, pending before the Court of Additional City Civil and Sessions Judge, FTSC-V, Bengaluru, arising out of Crime No.49 of 2025 registered by HAL Police Station, Bengaluru City for offences punishable under Section 64(1) of BNS, 2023 and Section 5(J)(II) and 6 of POCSO Act, 2012 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail.
2. Heard the learned counsel for the parties.

3. Perusal of the material on record would go to show that, petitioner who was arrested in the present case at the Crime stage was granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.2587 of 2025 disposed of on
17.04.2025. It appears that, for the reason that petitioner had not appeared before the trial Court in Special Case No. 209 of 2025 on the regular dates of hearing, non-bailable warrant was issued as against him and on 18.02.2026 he had voluntarily appeared before the trial Court and on the said date he was remanded to judicial custody. His bail application filed thereafter in Crl.Misc.No.2434 of 2026 was rejected by the trial Court on 02.04.2026. Therefore, is before this Court.
4. It is not in dispute that the petitioner has no other criminal antecedents. He is aged about 23 years. The alleged victim in the present case was aged about 17 years 5 months as on the date of registration of FIR. Considering the statement of the alleged victim under Section 164 of Cr.P.C, the trial Court had granted regular bail to the petitioner in Crl.Misc.No.2587 of 2025 disposed of on 17.04.2025. Only for the reason that he had not appeared before the trial Court on

the regular dates of hearing, petitioner has been now taken to custody on 18.02.2026. For the mistake committed by the petitioner he has been now sufficiently punished. He has undertaken to cooperate before the trial Court for speedy disposal of the case. Under the circumstances, the following:-

ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Special Case No.209 of 2025, pending before the Court of Additional City Civil and Sessions Judge, FTSC-V, Bengaluru, arising out of Crime No.49 of 2025 registered by HAL Police Station, Bengaluru City for offences punishable under Section 64(1) of BNS, 2023 and Section 5(J)(II) and 6 of POCSO Act, 2012, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court;

b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed off.
