And In the matter of: Binay Barman ….Petitioner. Mr. Hillol Saha Podder …for the Petitioner. Mr. Avrojyoti Das, Ld. APP Ms. Ruchika Agarwala Mr. Rajdeep Das … for the State. The petitioner prays for pre-arrest bail on the ground that his name transpired from the statement of the co-accused. Learned advocate for the State files an order passed by the learned Additional Sessions Judge, 1st Court, Cooch Behar (NDPS). It appears that warrant of arrest and thereafter WPA was issued against the petitioner. Under such circumstances, prayer for pre-arrest bail is rejected. The remedy of the petitioner is to surrender before the jurisdictional court and pray for regular bail. The application for anticipatory bail is, thus, dismissed.
