The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 215/2025, registered at Police Station AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN
2 Basantpur, District Rajnandgaon (CG) for the offence punishable under Sections 109(1), 331(8) of BNS and Sections 25 and 27 of Arms Act.

The prosecution story in brief, is that on 21.05.2025 at about 02:40 A.M., an unknown person assaulted Quarter Master Head Constable, Kishan Kumar Sahu with a sharp-edged weapon while he was sleeping in the Quarter Master/GD Office of ITBP 27th Battalion, with the intention to commit murder, causing grievous injuries on his neck, head, hands and arm. On the report of ASI Jawahar Singh, an offence was registered and investigation was undertaken. During investigation, statements of the complainant, duty personnel and injured were recorded, the spot was inspected and blood-stained articles and weapon were seized. On completion of investigation, charge-sheet was filed against the accused. Prima facie material is available showing commission of offence of attempt to murder, which is of serious nature.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He further submit that the FIR was registered against the unknown persons and the injured witness, who has suffered injuries has failed to identify the applicant. The applicant is in jail since 24.05.2025 and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail
3 application and submits that the charge-sheet has been filed in the present case before the competent Court. He further submits that as per CCTV footage from nearby areas, presence of Constable, Prateek Jagdale was revealed, who was identified by ITBP officials. On being taken into custody, the accused disclosed that due to a dispute over mess money, he attacked the injured with a sharp weapon used for cutting coconuts. The weapon and blood-stained clothes were seized at his instance and sent for FSL examination. Furthermore, the medical evidence shows that the injured sustained multiple incised and chop wounds on vital parts of the body, which were opined to be grievous in nature. He also submits that the applicant also received injuries in the said incident, while assaulting the injured. Therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the case-diary, it prima facie appears that the applicant was actively involved in the incident in question. The CCTV footage collected from the nearby area reveals the presence of the applicant at the place of occurrence and he has been duly identified by the ITBP officials. During investigation, the applicant, while in custody, disclosed that on account of a dispute relating to mess money, he assaulted the injured with a sharp- edged weapon used for cutting coconuts. Pursuant to such
4 disclosure, the weapon of offence as well as blood-stained clothes were seized at his instance and have been sent for FSL examination. The medical evidence on record shows that the injured sustained multiple incised and chop wounds on vital parts of the body, which have been opined to be grievous in nature.
It further emerges from the record that the applicant himself also sustained injuries during the course of the assault, lending corroboration to the prosecution case. Moreover, it also appears that during the course of trial, the applicant attempted to tamper with the prosecution witnesses, as a result of which the injured witness turned hostile and stated that he did not identify the applicant, despite the fact that he had sustained grievous knife injuries on his person. Considering the nature and gravity of the offence, the manner in which it was committed, the prima facie evidence available on record and the seriousness of the allegations involving an offence of attempt to murder, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant-Pratik Jagdale, involved in Crime No. 215/2025, registered at Police Station Basantpur, District Rajnandgaon (CG) for the offence punishable under Sections 109(1), 331(8) of BNS and Sections 25 and 27 of Arms Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to
5 proceed and concluded the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
