JUSTICE H.P.SANDESH ORAL ORDER The learned counsel for the revision petitioner and the learned counsel for the respondent would submit that after depositing the amount of Rs.1,50,000/-, the matter is settled between the parties for an amount of Rs.1,10,000/-. The amount of Rs.40,000/- was paid on 23.06.2026 and the same was acknowledged by the respondent. Today, the petitioner tendered an amount of Rs.70,000/- by way of cash and the same is acknowledged by the respondent. The amount deposited before the Trial Court i.e., Rs.1,50,000/- is ordered to be released in - 3 - HC-KAR CNR: KAHC010225052026 NC: 2026:KHC:38258 CRL.RP No. 530 of 2026 favour of the respondent, on proper identification and the revision petitioner has no objection for the same. 2. In view of the settlement arrived between the parties, the revision petition is disposed of acquitting the revision petitioner/accused for the offence punishable under Section 138 of the Negotiable Instruments Act. 3. The Trial Court had imposed the fine of Rs.5,000/- payable to the State and the learned counsel for the revision petitioner submits that the petitioner has already deposited Rs.2,500/- and going to deposit the balance amount of Rs.2,500/- within two weeks from today. Hence, the Trial Court is directed to collect the balance amount of Rs.2,500/-. If the revision petitioner has not deposited the earlier amount of Rs.2,500/- as submitted by the learned counsel for the revision petitioner, the Trial Court is directed to collect the entire amount of Rs.5,000/-.
