In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Survey Park (Women) Police Station Case No.03 of 2025 dated 07.10.2025 under Sections 376D/342/323/354C/406/506/114 of Indian Penal Code, 1860;
Shamiul Sarkar Versus State of West Bengal & Anr.
Mr. Milan Mukherjee Mr. Keshab Chandra Das Ms. Aparajita Mondal. …for the petitioner.
Mr. Krishnendu Bhattacharya Mr. Koustav Lal Mukherjee. …for the State.
Learned senior advocate appearing for the petitioner submits that the petitioner is similarly placed as the other accused, namely, Sk. Maniruddin @ Sekh Maniruddin who has been granted anticipatory bail in CRM(A)1022 of 2026.
Mr. Bhattacharya, learned Additional Public Prosecutor, opposes the prayer for anticipatory bail but is unable to refute the contention that the petitioner is not similarly placed as the other accused who has been granted anticipatory bail.
Having considered that the petitioner is similarly placed as the other accused, I am inclined to extend the same benefit. As such the prayer for anticipatory bail of the petitioner is allowed.
