The instant contempt petition has been filed alleging non-compliance of the order dated 19/02/2026 passed by this Court in WPS No.13654 of 2025, whereby Respondent No.3 therein i.e. CEO, Zila Panchayat, Bilaspur was directed to take a decision on the application of the petitioner seeking enhancement of subsistence allowance within a period of three weeks. At the outset, learned counsel for the Respondent would submit that upon receipt of the application of the petitioner the petitioner’s case was considered and it was found that the Fundamental Rules are not applicable on the Panchayat Employees and the petitioner being a Panchayat Secretary is not a Government employee and he was already getting 50% of the subsistence allowance and the prayer for increase in the subsistence allowance has been turned down vide order dated 20.04.2026 Annexure R/1. Therefore, there is no willful disobedience of the order passed by this Court. 3. I have gone through the order dated 20.04.2026 (Annexure R/1) perusal of the same would show that the case of the petitioner has been considered, therefore, there is no deliberate defiance on the part of the respondent authorities.
