Sabbir Biswas Mr. Yuvraj Chatterjee … for the petitioner(s) Mr. Koustav Lal Mukherjee … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been implicated on the basis of statement of a co-accused and is the victim of change of administration. Learned advocate for the State opposes the prayer for bail and submits that there are Call Data Records which reflect that there was a communication between the person who has been arrested and the present petitioner. However, on a query from this court, learned advocate submits that only one communication has been detected on the relevant date. 2 Having considered the nature of the accusations, I am inclined to grant anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Jafar Ali Mandal] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioner shall make himself physically available before the investigating officer of the case within a period of 10 days from date, thereafter, as and when called for by the Investigating officer of the case.
