By way of this petition, the petitioner has sought the following relief(s):- “10.1 That, this Hon'ble Court may kindly be pleased to quash circular Annexure P-1 to the extent that it denies the arrears of kramonnati pay scale from the date of entitlement and direction may be issued to grant monetary benefit of the kramonnati pay scale from the date of entitlement (on completion of 10/20 years of service), in the interest of justice. 10.2 That, this Hon'ble Court may kindly be pleased to direct respondent authorities to extent the benefit of time bound pay scale as per circular dated 04.08.2010 to the Assistant Teacher also, in the interest of justice. 10.3 Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.” 2. Learned counsel for the petitioners would submit that the petitioners were appointed as Assistant Teachers, and subsequently, they retired from services on account of superannuation in between they were promoted to the post of 4 Headmasters/Upper Division Teachers. He would contend that the petitioners were granted benefit of Kramonnati vetanman after completion of 12 years and 24 years of services according to the circular dated 19.04.1999 and 24.04.2006, but according to subsequent circular dated 04.08.2010 benefit of Kramonnati vetanman would be granted on completion of 10 years and 20 years of services. It is argued that a circular dated 10.03.2017 was issued by the respondent No. 1, which states that entitlement of Teachers, with regard to Kramonnati vetanman, would be notional and they would not be entitled for arrears. He would submit that petitioners are entitled for arrears of Kramonnati vetanman from the date of issuance of previous circulars. 3. On the other hand, learned counsel for the State would oppose. He would submit that a policy decision was taken and period of 12 years was reduced to 10 years and period of 12 years was reduced to 20 years vide circular dated 10.03.2017. He would submit that Teachers and Assistant Teachers are still getting benefit of Kramonnati vetanman according to circular dated 10.03.2017 and therefore, this petition deserves to be dismissed. 4. Heard. 5. Having considered the fact that the benefit of Kramonnati vetanman is being extended to the Teachers and Assistant Teachers on completion of 10 years and 20 years of service respectively, pursuant to the revised period of entitlement, in the opinion of this Court, no case is made out for interference.
