Smt.Priyanka S.Angadi., counsel for the petitioner and Francis Xavier., counsel for respondent No.1 have appeared in person. 2. Though the matter is listed today for preliminary hearing, it is heard finally. 3. The captioned writ petition is filed seeking a writ of certiorari to quash the proceedings in O.A.No.1344/2024 filed by respondent No.1 under Section 19 of the DRT Act, before the DRT No.I at Bangalore as against the above petitioner (Annexure-A). - 3 -

4. Counsel for the respective parties urged several contentions. It has been vehemently contented on behalf of the petitioner that he has already retired from the partnership firm. Hence, no proceedings could have been initiated as against him. Francis Xavier submits that the petitioner is respondent No.2 in the O.A. and the same is pending for adjudication, hence, he cannot parallely prosecute the proceedings. 5. The contentions presented on behalf of the respective parties is noted with care. 6.
A perusal of the application filed under Section 19 of the Recovery of Debts and Bankruptcy Act, 1993 Act at Annexure-P, reflects that the petitioner is respondent No.2 in O.A. Hence, he may agitate his grievance in the pending proceedings before the Tribunal. Hence, there is no need to exercise discretionary powers under writ jurisdiction. The petition is devoid of merits. Accordingly, the writ petition is dismissed. - 4 -
