The petitioners are apprehending their arrest in connection with Barkagaon P.S. Case No.231 of 2025 for the alleged offences registered under Sections 190, 191(2), 115(2), 126(2), 132 and 352 of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate First Class, Hazaribag. 3. Learned counsel appearing for the petitioners submits that agitation was going on for rehabilitation of affected persons whose land has been acquired in the project of NTPC. He further submits that the allegation is there against 25 persons. He then submits that the petitioners were not involved in the said agitation and they were 2026:JHHC:9924 --2-- A.B.A. No. 1343 of 2026 only standing nearby and in view of that the petitioners have been implicated. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.18 of the petition. He also submits that so far criminal antecedent in the impugned order is concerned that is of other accused persons. 4. Learned counsel appearing for the State opposed the prayer and submits that allegations are there of stopping the conveyor belt which is meant for transporting the coal. 5. Considering that the petitioner was said to be standing nearby the agitation place and the agitation was going on for rehabilitation by the villagers pursuant to the project of NTPC and the petitioners have got no criminal antecedent as disclosed in paragraph No.18 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
