1. Heard learned counsel for the applicant and learned counsel for the respondent.
2. This C24 application has been filed with the prayer to transfer Civil Suit No. 145 of 2024, “Shri Jyotisagar Pandey vs. Smt. Poonam Paladiya”, under Section 13 of the Hindu Marriage Act, 1955, pending before the Court of learned Family Judge, Family Court, Almora to the Court of learned Family Judge, Family Court, Haldwani, District Nainital or any other court having similar jurisdiction.

Learned counsel for the applicant submits that respondent is husband of the applicant and their marriage was solemnized on 06.05.2019; that, the applicant gave birth to a son, who is now three years old and is living with the applicant; that, just to harass the applicant the respondent filed a case under Section 13 of Hindu Marriage Act,1955, which is pending before the Principal Judge, Family 1
2026:UHC:2047 Court Almora; that she had also filed a case under Section 125 Cr.P.C. which is pending in the court of Additional Family Court Judge, Haldwani; that, the applicant is totally dependent on her parents and it is very difficult for her to attend the court at Almora on each and every date of hearing since she has no accommodation to stay in Almora.

Learned counsel appearing for the respondent has filed counter affidavit, however, he orally submitted that he has no objection if the case is transferred from District Almora to District Nainital or any other court having similar jurisdiction. He however submits that the Court may be directed to decide the case expeditiously.
5. Accordingly, the instant C24 application is allowed. Thus, Suit No. 145 of 2024, “Shri Jyotisagar Pandey vs. Smt. Poonam Paladiya”, under Section 13 of the Hindu Marriage Act, 1955, pending before the Court of learned Family Judge, Family Court, Almora is transferred to the Court of learned Family Judge, Family Court, Haldwani, District Nainital. The learned Court is directed to hear and decide the case as expeditiously as possible.
6. As a sequel thereto, the miscellaneous application, if any shall also stand disposed of.
7. Let a copy of this order be sent to the court concerned for compliance.
