Accused No.2 in Crime No.124/2021 registered by Viveknagar Police Station, Bengaluru, for the offences punishable under Sections 399 and 402 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Perusal of the material on record would go to show that petitioner, who was arrested in the present case earlier was granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.25894/2021 vide order dated 17.08.2021. It appears that for the reason that petitioner had not appeared before the Trial Court on the regular dates of hearing, coercive steps were taken against him and he was arrested on 29.12.2025 and on the said day, he was remanded to judicial custody. His bail application filed before the jurisdictional - 3 - HC-KAR CNR: KAHC010406192026 NC: 2026:KHC:38173 CRL.P No. 8530 of 2026 Sessions Court in Crl.Misc.No.25408/2026 was rejected on 21.05.2026. Therefore, he is before this Court. 4. Perusal of the order passed in Crl.Misc.No.25894/2021 would go to show that petitioner is a person without any criminal antecedents. On the merits of the case, he has been granted regular bail earlier and only for the reason that he had not appeared before the Trial Court on the regular dates of hearing, he has now been arrested and is in custody for the last more than six months. For the mistake committed by the petitioner by not appearing before the Trial Court on the regular dates of hearing, he has been sufficiently punished. He has undertaken to abide by the conditions that may be imposed on him. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.124/2021 registered by Viveknagar Police Station, Bengaluru, for the offences punishable under Sections 399 and 402 of IPC, subject to the following conditions: - 4 - HC-KAR CNR: KAHC010406192026 NC: 2026:KHC:38173 CRL.P No. 8530 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
