(At Present Confined In Central Jail Alwar, District Alwar). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Madhukar Shyam Meena Mr. Pushpendra For Respondent(s) : Mr. Vivek Chaudhary, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 23/04/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 37/2026 registered at Police Station Kotwali Alwar District Alwar for the offences under Sections 110, 115(2) and 126(2) of BNS and Section 3(2)(va) of SC/ST Act.
2.
Learned counsel for the accused-petitioner submits that the accused has been falsely implicated in this case. It is contended that prima facie no offence under Section 109(1) of the BNS Act is made out. Although the medical jurist has opined that the injuries may be dangerous to life, the discharge ticket clearly indicates that the injuries were treated, and stitches were applied to the neck. Furthermore, the concerned medical jurist has concluded
[2026:RJ-JP:17261] (2 of 3) [CRLMB-5223/2026] that none of the injuries are life-threatening or cause the death of the injured. The accused-petitioner is in custody since 09.03.2026 and the trial of the case may take considerable time. There are no criminal antecedents against the petitioner, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and has submitted the case diary along with a factual report. The complainant was treated at SMS Hospital, Jaipur and the discharge summary reveals that there was a clean, sharp lacerated wound over the lateral aspect of the left infundibular region, with the patient being admitted in a condition of active bleeding. However, after receiving treatment, the patient recovered and the bleeding was controlled. The injured remained hospitalized for three days and was discharged thereafter. Therefore, considering the above facts, his bail application deserves to be dismissed.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for the parties and looking to the fact that the accused-petitioner is in custody since 09.03.2026 and the trial of the case may take considerable time, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused- petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Gurdeep Singh @ Deepu S/o Sohan Singh, in connection with FIR No. 37/2026 registered at Police Station Kotwali District Alwar shall be enlarged on bail provided he furnishes a personal bond in the sum
[2026:RJ-JP:17261] (3 of 3) [CRLMB-5223/2026] of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
