Kausik (Rejected) CRM (M) 1536 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Ashokenagar Police Station Case No. 485 of 2025 dated 04.08.2025 under Section 103(1)/61(2)/238(a) of BNS, 2023. And In the matter of : Sambhu Paul ……Petitioner. Mr. Apalak Basu Mr. Nazir Ahmed Ms. Sanghamitra Mridha Mr. Yavik Singhal ……for the Petitioner. Mr. L. Vishal Kumar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is innocent of the charges and is unnecessary languishing in custody for about 11 months. Charge sheet has been submitted. As such, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that out of 39 witnesses cited by the prosecution 7 witnesses have been examined. Having regard to the merits of the case and the manner in which the prosecution is progressing in the present case, at this stage, I am not inclined to release the petitioner on bail considering the chain of circumstances which has been 2 primarily relied upon by the prosecution. However, petitioner would renew his prayer for bail after a period of 6 months. Prosecution is directed to ensure that all the vulnerable and relevant witnesses are examined within the aforesaid period. With the aforesaid observations CRM (M) 1536 of 2026 is dismissed. Prosecution is directed to communicate this order to the learned Trial Court. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
