Learned advocate appearing for the petitioners submit that the petitioners have been falsely implicated in connection with the instant case. Learned advocate appearing for the State has produced the Case Diary along with the opinion in respect of the injury sustained by the victim/injured. The opinion of the concerned RMO of Malda Medical College and Hospital reflects that the injuries are simple. Having considered the same, I am inclined to allow the prayer for anticipatory bail of the petitioners namely, Goutam Das, Som Banerjee @ Somu, Anup Ghosh and Sumon Poddar. As such, I direct that in the event of arrest, the petitioners shall furnish bonds subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions
2 as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As, the investigation of the case is in progress, petitioners shall make themselves available before the investigating officer within a period of 10 days from date, the investigating officer of the case, thereafter, as and when required called for the petitioners for the sake of investigation. With the aforesaid observations, CRM (A) 2012 of 2026 is allowed. Opinion on injury report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
