Mr. Anish Ray Mr. Danial Hossain Mr. Syed Murshid Alam Ms. Barnali Gupta Mr. Subrata Ghosh Ms. Reshma Khatun Mr. Prosenjit Das
… For the petitioner
Mr. Pradip Paul Ms. Renesa Dey
… For the State
1. The petitioner claims to be serving as a teacher in a Government aided school since 2008. He relies upon a certificate issued by the Teacher-in- Charge of the school in September, 2019 certifying that the petitioner has been teaching in the school since 2008 as Part Time Teacher in the higher secondary level. Relying on such certificate, the petitioner seeks a direction upon the State respondents for increasing his honorarium.
2. It appears from the documents annexed to the writ petition that there is nothing to show that the petitioner was appointed in the school in accordance with law.
2
3. The Court is of the opinion that in the absence of any supporting document in respect of his appointment in a regular post in the manner provided in law, the prayer of the petitioner for directing the respondent to increase his honorarium cannot be accepted.
4. The Court has not been made aware as to the mode of recruitment of the petitioner. Any person appointed by the school as Part Time Teacher, without following the due process of law, cannot claim the same status of a teacher appointed after conducting a regular recruitment process.
5. In view of the above, no relief can be granted to the petitioner in the instant writ petition.
6. The writ petition fails and is hereby dismissed.
7. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.
8. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
