Learned advocate for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case and the dispute is because of political vendetta. Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the letter of the BDO. I find from the letter of the BDO that the job cards were issued in the year 2007 and 2008. Having considered the period of time and the fact that the petitioner has not absconded and, at present, is
2 available at the location, I am of the opinion that custodial detention of the present petitioner may not be warranted in the facts and circumstances of the present case. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Sk. Abdul Alim @ Sk. Khudu] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioner shall make himself physically available before the investigating officer of the case within a period of 10 days from date, thereafter, as and when called for by the Investigating officer of the case. Accordingly, CRM (A) 1977 of 2026 is disposed of. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
