27.07.2026 Court No.35. D/L. 283. Kausik (Rejected) CRM (M) 1544 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nabadwip Police Station Case No. 248 of 2025 dated 07.04.2025 under Sections 115(2)/329(4)/351(2)/70(1)/74/3(5) of BNS, 2023. And In the matter of : Abdul Mondal @ Rakesh Mondal & Ors. ……Petitioner. Mr. Sagar Saha Mr. Manjeet Saha Mr. Subhrajyoti Das ……for the Petitioner. Mr. Bhaskar Seth ……for the State. Learned advocate appearing for the petitioners submits that the petitioners are in custody for 1 year 3 months and has been falsely implicated in the instant case. It has been contended that petitioner altered her case in the statement under Section 164 Cr.P.C. There was a completely different case when the complaint was lodged with the Inspector-in- Charge. Learned advocate for the State opposes the prayer for bail. I have taken into account that the victim has been examined but however the examination of the victim is of no help to the present accused persons. As the trial of the case is 2 progressing smoothly, I am of the opinion that, at this stage, it would not be fit and proper to release the petitioner on bail. Petitioner will renew his prayer for bail after the evidence of the relevant witnesses are over. Accordingly, CRM (M) 1544 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
