CIVIL JUDGE AND JMFC, SIRA IN O.S.NO.403/2026, VIDE ANNEXURE-L BY ISSUE OF WRIT IN THE NATURE OF CERTIORARI OR ANY OTHER WRIT, ORDER OR DIRECTION AS A CASE MAY BE. THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE SMT. JUSTICE LALITHA KANNEGANTI ORAL ORDER The petitioner is aggrieved by the order dated 08.06.2026 passed in O.S.No.403/2026 by the Principal Civil Judge and JMFC, Sira, whereby the Principal Civil Judge and JMFC, has addressed a letter to the Principal District and Sessions Judge, Tumakuru, for transfer of the case for further necessary action in this matter. 2. This matter pertains to the disputes in the Bar Association and it is submitted that expressing the difficulty, the learned Judge has sought appropriate orders from the Principal District and Sessions Judge, Tumakuru, to transfer - 3 - HC-KAR CNR: KAHC010390672026 NC: 2026:KHC:38513 WP No. 17726 of 2026 this matter. It is the submission that now the matter is transferred to the IV Additional Civil Judge and JMFC, Tumakuru. It is submitted that there is dispute between the members of the governing body of the Bar Association and he is questioning the action of some of the members contrary to the by-laws and this Court may direct the respondents not to precipitate the matter. 3. Learned counsel appearing for the respondents submits that the present writ petition is not maintainable. It is submitted that already the matter is transferred and the Court will hear the matter and pass appropriate orders. 4. Having heard the learned counsels on either side, perused the entire material on record. The proceedings dated 08.06.2026 are questioned before this Court. This Court does not find any reason to interfere with the impugned proceedings. This Court finds no force in the submission of the learned counsel for the petitioner that this Court shall pass some order till the matter is heard by the learned Judge. Considering the sensitive nature of the issue, the Court has to apply its mind and hear the parties, and, based on that, an appropriate order - 4 - HC-KAR CNR: KAHC010390672026 NC: 2026:KHC:38513 WP No. 17726 of 2026 needs to be passed. Those issues cannot be decided by the Court by a one-line order. Hence, balancing the interests of both the parties, this Court deems it appropriate to pass the following order: ORDER i. The IV Additional Civil Judge and JMFC, Tumakuru, is directed to dispose of I.A.Nos.1 and 2 within a period of one week from the date of receipt of the copy of this order. ii. Accordingly, the writ petition is disposed of. iii. All I.As. in this petition shall stand closed. SD/- (LALITHA KANNEGANTI) JUDGE MEG List No.: 1 Sl No.: 52
