ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.51 and 52 on bail in Crime No.97 of 2025 of Atchutapuram Police Station, Anakapalli District, registered against the Petitioners/Accused Nos.51 and 52 herein for the offences punishable under Sections 318(4), 61(2), 111(2)(b), 111(3) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Mr. D.Taraka Prasad, the learned counsel for the Petitioners, submits that the Petitioners are innocent of the alleged offence and they have been falsely implicated in the alleged offence. They have not committed any offence. They are law-abiding citizens. They have got fixed abode. The Petitioners undertake to abide by any conditions that this Court may impose while granting bail to the Petitioners. The learned counsel further submits that Accused Nos.1 to 26 and 27 to 33 have already been enlarged on bail by the learned Trial Court. 3. Per contra, Ms.P.Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioners on the ground that serious allegations are levelled against them. It is alleged that they were involved in running a call centre and in handling and transporting hawala proceeds. The investigation is at a nascent stage. So far, only 45 witnesses have been examined, and nearly 1,000 more victims are yet to be identified and examined.
Hence, it is urged to dismiss the petition. 4. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 5. As seen from the record, the petitioners are arrayed as Accused Nos.51 and 52. It is alleged that they were involved in running a call centre and in handling and transporting hawala proceeds. The petitioners were arrested on 22.05.2026 based on the confession of the other accused. They have been in judicial custody for only the past 25 days. It is reported that nearly 1,000 more victims are yet to be identified and examined. So far, only 45 witnesses have been examined. The investigation is still at a nascent stage and some more material witnesses are yet to be examined. A substantial portion of the investigation remains to be completed. Therefore, the request for enlarging the petitioners on bail at this juncture is not found convincing
