Since common questions of fact and law arise for consideration in this batch of writ petitions, they were heard analogously and are being disposed of by this common order. 2. The controversy involved in the connected writ petitions is substantially identical and arises out of the interpretation and implementation of the 30 policy governing grant of advance increments to Assistant Professors possessing M.Phil. qualification under the Higher Education Department of the State of Chhattisgarh. As the pleadings in WPS No. 6505 of 2024 comprehensively set out the factual matrix giving rise to the present controversy, the pleadings and the documents of the said writ petition are being referred to for the sake of convenience. The decision rendered herein shall govern all the connected writ petitions. 3. The petitioners are Assistant Professors serving in different Government Colleges under the Higher Education Department of the State of Chhattisgarh. They possess the qualification of M.Phil. and claim entitlement to advance increments under the revised pay structure adopted by the State Government pursuant to the recommendations of the University Grants Commission (henceforth ‘the UGC’). According to them, upon their appointment, they were granted three non- compounded advance increments on account of possessing the qualification of M.Phil., and their pay was fixed accordingly by the competent authority. The dispute arose when the State Government issued Circular dated 25.06.2024 (Annexure-P/2), followed by the consequential communication dated 19.07.2024 (page 25 of Annexure- P/3) and 20.07.2024 (page 27 of Annexure-P/3), directing implementation of the revised policy governing grant of such increments, pursuant to which action was initiated for revision of the petitioners' pay fixation and recovery of the alleged excess payment. Aggrieved thereby, the petitioners have instituted the present batch of 31 writ petitions invoking the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India. 4. (a) Learned counsel appearing for the petitioners submit that the petitioners were appointed as Assistant Professors after acquiring the qualification of M.Phil. and, in terms of the revised pay scheme adopted by the State Government vide order dated 30.03.2010 (Annexure-P/1), were granted three non-compounded advance increments. It is contended that the grant of such increments was neither provisional nor erroneous but was made by the competent authority after due verification of the petitioners' eligibility. Ever since their appointment, the petitioners have been drawing salary on the basis of such pay fixation without any objection from the respondents. (b) It is further submitted that the Government Order dated 30.03.2010, issued pursuant to the implementation of the UGC pay revision scheme, specifically contemplated grant of advance increments to teachers possessing M.Phil. qualification. According to the petitioners, the benefit was extended strictly in accordance with the policy prevailing on the dates of their respective appointments and, therefore, the respondents cannot retrospectively alter the conditions governing their pay by issuing the subsequent corrigendum dated 25.06.2024. It is urged that the corrigendum cannot be construed so as to divest the petitioners of a benefit which had already accrued and formed part of their pay fixation. 32 (c) Learned counsel further submit that the communication dated 19.07.2024, directing withdrawal of the advance increments and consequential refixation of pay, is arbitrary, unreasonable and contrary to the object of the UGC pay revision scheme. It is contended that the respondents have proceeded on an erroneous interpretation of the applicable UGC provisions and Government orders while overlooking the fact that the petitioners' entitlement stood determined on the dates of their appointments under the policy then prevailing. The subsequent corrigendum, according to the petitioners, cannot retrospectively take away a vested monetary benefit. (d) It is also submitted that the proposed recovery of the excess amount is wholly unsustainable in law. The petitioners contend that the grant of advance increments was made by the competent authority after scrutiny of their eligibility and that they neither misrepresented any fact nor practised any fraud. Consequently, they cannot be penalised for any alleged error committed by the Department. It is further urged that recovery after several years would cause serious financial hardship and would be contrary to the settled principles governing recovery of excess payments made to Government servants. On these premises, it is prayed that the corrigendum dated 25.06.2024, the communication dated 19.07.2024 & 20.07.2024, and all consequential actions be quashed, and the respondents be directed to continue the benefit of the advance increments already granted along with all consequential service and monetary benefits. 33 5. (I) Per contra, learned State counsel submits that the impugned action is in consonance with the statutory framework governing the grant of advance increments to teachers. It is contended that the University Grants Commission (Minimum Qualifications for Appointment of Teachers and other Academic Staff in Universities and Colleges and Measures for the Maintenance of Standards in Higher Education) Regulations, 2010 (henceforth ‘the UGC Regulations’), framed under Section 26 of the University Grants Commission Act, 1956, have statutory force and are binding upon the State Government. Reliance is placed upon Regulation 9.2, which provides that an M.Phil. degree holder at the time of recruitment as Assistant Professor is entitled only to two non-compounded advance increments. (II) It is further submitted that the Government Order dated 30.03.2010 was issued while implementing the UGC pay revision scheme pursuant to the communications issued by the Government of India and the UGC. According to the respondents, upon noticing that the provision relating to grant of three advance increments to M.Phil. degree holders was not in conformity with the governing UGC framework, the State Government issued the corrigendum dated 25.06.2024 so as to align its executive instructions with the applicable UGC Regulations. The communication dated 19.07.2024 merely directs implementation of the said corrigendum by undertaking refixation of pay in accordance with law. It is, therefore, contended that neither the corrigendum nor the consequential communication suffers from any legal infirmity. 34 (III) Learned State counsel further submits that no vested or indefeasible right can accrue in favour of the petitioners on the basis of a benefit extended contrary to the governing statutory framework. It is contended that once the discrepancy was noticed, the respondents were duty bound to rectify the pay fixation in accordance with law and the consequential recovery, if any, is merely incidental to such lawful refixation. 6. (A) Learned counsel appearing for the UGC submits that Regulation 9.2 of the UGC Regulations unequivocally provides that an M.Phil. degree holder at the time of recruitment as Assistant Professor is entitled to only two non-compounded advance increments. It is submitted that the Regulations have been framed in exercise of statutory powers under the University Grants Commission Act, 1956 and are binding upon all Universities and institutions governed thereby. (B) It is further submitted that under the subsequent pay revision scheme introduced by the Ministry of Human Resource Development, the incentive structure has been merged with the revised pay structure and, consequently, no separate advance increments are envisaged for acquiring M.Phil. or Ph.D. qualifications thereafter. It is, therefore, prayed that the controversy be adjudicated in accordance with the statutory Regulations governing the field. 7. Learned counsel appearing for the Accountant General submits that the office of the Accountant General has neither framed the policy governing grant of advance increments nor issued the impugned orders. 35 It is contended that the matters relating to grant of increments, pay fixation and refixation are governed by the orders issued by the Higher Education Department of the State Government, whereas the role of the Accountant General is confined to verification in accordance with the Government orders. It is, therefore, submitted that no relief is claimed or can be granted against the Accountant General in the facts of the present case. 8. I have heard learned counsel for the parties at length and have carefully perused the pleadings, the documents brought on record and the relevant policy as well as the statutory provisions governing the field. 9. The principal question which arises for consideration in this batch of writ petitions is whether the petitioners, who possessed the qualification of M.Phil. at the time of their appointment as Assistant Professors, acquired a vested or enforceable right to three non-compounded advance increments on the strength of the Government Order dated 30.03.2010 and, consequently, whether the State Government was justified in issuing the corrigendum dated 25.06.2024 and the consequential communication dated 19.07.2024 & 20.7.2024 directing refixation of pay and withdrawal of the excess benefit, if any, in accordance with the governing statutory framework. 10. The controversy essentially turns upon the relationship between the executive instructions issued by the State Government while implementing the UGC pay revision scheme and the statutory Regulations subsequently framed by the UGC under the University 36 Grants Commission Act, 1956. It is, therefore, necessary to examine the scheme governing grant of advance increments to teachers appointed in Government Colleges. 11. The Government Order dated 30.03.2010 itself records that it was issued in pursuance of the communications issued by the Ministry of Human Resource Development, Government of India, dated 31.12.2008 and 04.06.2009, as well as the communication issued by the UGC dated 27.02.2009, whereby the revised UGC pay revision scheme was adopted by the State Government with effect from 01.01.2006. In fact, the UGC, in exercise of the powers conferred under Section 26 of the University Grants Commission Act, 1956, notified the UGC Regulations, which govern, inter alia, the incentive structure relating to advance increments. 12. Regulation 9 of the UGC Regulations deals with incentive increments. Regulation 9.1 provides for grant of five non-compounded advance increments to a candidate possessing a Ph.D. Degree at the time of recruitment as Assistant Professor, whereas Regulation 9.2 provides that a candidate possessing an M.Phil. Degree at the time of such recruitment shall be entitled to two non-compounded advance increments. The Regulations, thus, make a clear distinction between the incentives admissible to Ph.D. and M.Phil. degree holders. 13. The petitioners principally contend that since the Government Order dated 30.03.2010 was in force on the dates of their respective appointments and the benefit of three non-compounded advance increments had been extended by the competent authority, the 37 respondents are precluded from modifying the said benefit by issuing the corrigendum dated 25.06.2024. It is their submission that the benefit, once granted, became part of their pay structure and could not thereafter be withdrawn. 14. The aforesaid contention, though attractive at first impression, cannot be accepted. The Government Order dated 30.03.2010 was issued by the State Government for implementation of the UGC pay revision scheme and cannot be construed as an independent or self-contained source of entitlement. Once the UGC notified the Regulations in exercise of the powers conferred under Section 26 of the University Grants Commission Act, 1956, the executive instructions issued by the State Government were necessarily required to operate in harmony with the statutory Regulations. The corrigendum dated 25.06.2024 merely ensured such conformity and cannot be construed as introducing any new condition affecting the service rights of the petitioners. 15. A plain reading of Regulation 9.2 leaves no manner of doubt that an M.Phil. Degree holder at the time of recruitment as Assistant Professor is entitled to only two non-compounded advance increments. The language employed in the UGC Regulation is explicit and admits of no ambiguity. Neither expressly nor by necessary implication does the Regulation envisage grant of three advance increments to an M.Phil. degree holder. 16. The corrigendum dated 25.06.2024, therefore, cannot be viewed as introducing a fresh condition governing the service of the petitioners. It 38 merely seeks to align the executive instructions contained in the Government Order dated 30.03.2010 with the statutory framework governing the field. The consequential communication dated 19.07.2024 & 20.7.2024 directing implementation of the corrigendum is only an administrative consequence flowing therefrom. 17. The submission that the petitioners acquired a vested or indefeasible right merely because the benefit had been extended by the competent authority also deserves rejection. The entitlement of a Government servant to monetary benefits must necessarily be tested on the touchstone of the governing statutory provisions. Merely because an executive instruction remained in operation for some time or an erroneous benefit came to be extended thereunder does not create a vested right to continue receiving a benefit which is otherwise not admissible under the governing statutory framework. 18. Much emphasis was laid by the learned counsel for the petitioners on the submission that the petitioners had neither practised any fraud nor made any misrepresentation while obtaining the benefit of advance increments. According to the petitioners, the respondents are, therefore, estopped from directing refixation of pay and recovery after several years. 19. The aforesaid submission also does not merit acceptance. The controversy in the present case does not turn upon the existence or absence of fraud or misrepresentation but upon the legality of the grant itself. Once it is found that the petitioners were not legally entitled to 39 three non-compounded advance increments under the governing scheme, continuation of such benefit cannot be justified merely because the higher benefit had been extended by the competent authority at the time of initial pay fixation. The absence of any misrepresentation on the part of the petitioners cannot validate a benefit which is otherwise not admissible in law. 20. The challenge to the consequential recovery also cannot be examined in isolation from the legality of the refixation of pay. Once the respondents have undertaken refixation in accordance with the governing provisions regulating grant of advance increments, the consequential recovery, if any, is merely incidental thereto. It is also relevant to note that the petitioners are Assistant Professors holding Class-II posts. In the facts of the present case, where the recovery is only consequential to lawful refixation of pay undertaken to bring the pay fixation in conformity with the governing statutory framework, this Court finds no ground to interfere with the impugned action in exercise of its extraordinary jurisdiction under Article 226 of the Constitution of India. 21. It is noteworthy to mention here that excess payment of public money cannot ordinarily be retained merely because the overpayment resulted from a bona fide mistake of the employer. Public funds do not belong either to the officer responsible for the erroneous disbursement or to the recipient who received the excess amount. Any amount paid or received without the authority of law carries with it a corresponding obligation on the recipient to refund the same, failing which it would amount to unjust enrichment. 40 22. The recovery of excess payment is the general rule, whereas exemption from recovery constitutes a narrow exception, to be invoked only in exceptional factual situations where equitable considerations outweigh the State's right to recover public money. Consequently, in every case involving recovery of excess salary, the Court is required to examine whether the employee falls within the limited equitable exceptions recognised by law; failing such circumstances, recovery cannot be interdicted merely because the excess payment was occasioned by an administrative or bona fide mistake. 23. The Supreme Court in Chandi Prasad Uniyal & Others v. State of Uttarakhand & Others, (2012) 8 SCC 417, held that any amount paid/received without authority of law can always be recovered. It further held that law imposes an obligation on payee to repay the money lest, it would amount unjust enrichment. 24. In view of the foregoing discussion, this Court is of the considered opinion that the corrigendum dated 25.06.2024 and the consequential communication dated 19.07.2024 & 20.7.2024 have been issued to ensure conformity of the State Government policy with the governing statutory framework regulating grant of advance increments to Assistant Professors. The petitioners have failed to establish any enforceable legal right to claim three non-compounded advance increments or to seek continuance of a benefit beyond that admissible under the governing statutory provisions. 41 25. Consequently, no ground warranting interference in exercise of the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India is made out. 26. Resultantly, all the writ petitions, being devoid of merit, deserve to be and are hereby dismissed, leaving the parties to bear their own cost(s). Sd/- (BIBHU DATTA GURU) JUDGE Rahul
