The petitioner is serving in the post of assistant teacher in Physical Education. He seeks higher scale of pay. The legal representation on behalf of the petitioner is pending consideration at the end of the respondent authorities. 3. As it appears that the request made by the petitioner seeking higher scale of pay is pending consideration at the end of the respondents, accordingly, no useful purpose will be served by keeping the writ petition pending. 4. The instant writ petition stands disposed of by directing the District Inspector of Schools (Secondary Education), Barrackpore to take a decision on the petitioner’s prayer strictly in accordance with law at the 2 earliest but positively within a period of twelve weeks from the date of communication of this order. 5. An opportunity of hearing shall be granted to the petitioner prior to passing a final order in the matter. It will be open for the petitioner to rely upon the judicial precedents in this regard at the time of hearing. 6. A reasoned order shall be passed and communicated to the petitioner without any delay. 7. Learned advocate for the petitioner is directed to forward a copy of the subject representation to the District Inspector of Schools (Secondary Education), Barrackpore at the time of communicating the order of the Court. 8. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 9.
