Learned Senior Counsel Mr. S. Sarkar assisted by Mr. K. D. Singha, Learned Counsel is present for the petitioner. Learned D.S. G.I. Mr. B. Majumder is present on behalf of the respondents. The respondents CBI by this time have filed their affidavit in opposition and in addition to that one additional affidavit along with certain documents have been filed by the petitioner. At the time of hearing Learned Senior Counsel Mr. Sarkar drawn the attention of the Court that in this case the chargesheet is submitted against the petitioner and others and now the case is
pending for disposal before the Learned Special Judge(CBI). But the grievance of the petitioner is that he is presently serving in Bangalore in a private concern and his monthly salary is entered in the respective account which has been freezed as per order of the Division Bench of this High Court on 19.01.2023 in WP(Crl.) No.3 of 2014 and if the petitioner is not allowed to withdraw his money from his respective account then he will be under starvation and also he is facing severe financial hardships as because in spite of rendering service he is not in a position to withdraw any money from the respective bank account which has been freezed. Learned D.S.G.I. Mr. B. Majumder appearing for the respondent submitted that the present petitioner is one of the prime accused and was the Director of the concerned company against whom the prosecution was launched and as per order of the Division Bench of this High Court all the properties, PAN cards, Aadhar cards including the bank accounts of those companies were freezed in course of investigation and as such if any relief is to be given in that case that can only be considered by the Division Bench of this High Court who passed the order in the aforesaid case. So according to Learned D.S.G.I. this present petition is not maintainable. Considered. The petitioner has filed this application under Section 482 of Cr.P.C. for setting aside of the order dated 08.08.2025 passed by Learned Special Judge, CBI in the aforenoted case. It is the admitted position that in the aforenoted case the chargesheet has been submitted by CBI against the present petitioner and others. Page 3 of 3
Now the matter is pending for trial before the concerned Learned Court of Special Judge, CBI. It is also on record that in course of investigation as per order dated 19.01.2023 of a Division Bench of this High Court in WP(Crl.) No.3 of 2014 all the bank accounts and other documents were seized/freezed by CBI. Although Learned Senior Counsel appearing for the petitioner in course of hearing submitted before this Court that the present petitioner is only willing to withdraw his salary amount from the respective account which was deactivated/freezed during investigation by CBI and as the account was freezed as such he is not in a position to withdraw the money and furthermore he is serving in another private concern at Bangalore. Since the account was freezed in pursuance of the order of the Division Bench of this High Court dated 19.01.2023 in WP(Crl.) No.3 of 2014, so that this Court is not in a position to accord any relief, allowing the petitioner to withdraw the money from his respective account which has been freezed. So the present petitioner is at liberty to approach for modification/seeking appropriate relief to the concerned Division Bench of this High Court. With this observation, this present petition stands disposed of. JUDGE
