Jotendro, learned senior counsel assisted by Mr. David Boon, learned counsel appeared for the petitioner; Mr. M. Devananda, learned senior counsel and Addl. AG assisted by Mr. Tomclist, learned counsel appeared on behalf of respondent No. 1. None appeared on behalf of respondent No. 2. [2] The present contempt case has been filed for the alleged wilful and deliberate disobedience of the judgment and order dated 06-06-2022 passed by this court in WP(C) No. 34 of 2020. It is on record that the intra-court writ appeal filed by the State Government and thereafter, the SLP filed by the State Government against the aforesaid order passed by the learned Single Judge has been affirmed and the matter has reached its finality. Case (C)) No. 30 of 2026 Contd…/- has been complied with, however, as the direction of this court is yet to be complied with by the respondent No. 1, eight weeks’ time was granted with the condition that if the respondent No. 1 failed to submit compliance report on the next date of hearing, he shall appear before this court personally to explain the reason for not submitting compliance report. The earlier proceeding dated 13-03-2026 of this court are reproduced hereunder:- “13.03.2026 Mr. M. Devananda, learned senior counsel and Addl. AG assisted by Mr. Tomclist, learned counsel appeared on behalf of the respondent No. 1 and Mr. Md. Fakharuddin, learned counsel appeared on behalf of the respondent No. 2. It has been submitted by Md. Fakharuddin, learned counsel appearing for the respondent No. 2 that the respondent No. 2 had already complied with the direction given by this Court on his part and further compliance will be made by the respondent No. 1. Mr. M. Devananda, learned senior counsel appearing for the respondent No. 1 submitted that active actions are being taken up by the respondent No. 1 for complying with the direction given by this Court and that if 8 weeks’ time is given to the respondent No. 1, he will be able to submit compliance report. Mr. David Boon, learned counsel appearing for the petitioner submitted that the direction given by this Court was on 06.06.2022 and ample opportunity has been given to the respondents for complying with the said direction. The learned counsel accordingly submitted that no further time be given to the respondents for complying with the direction given by this Court after 8 weeks from today. In view of the submission made by the counsel appearing for the parties, Registry is directed to list this case again on 08.05.2026. -2- MC(Cont. Case (C)) No. 30 of 2026 Contd…/- It is made clear that in event the respondent No. 1 fail to submit compliance report on the next date, he shall appear before this Court personally at 10:30 am to explain the reason for submitting compliance report. Registry is directed to furnish a copy of this order to all the counsel appearing for the parties through their WhatsApp/e-mail for doing the needful.” [4] The respondent No. 1 filed an application being MC(Cont. Case (C)) No. 30 of 2026 stating therein the action taken by the respondents for complying with the direction given by this court and with a prayer for dispensing his personal appearance before this court as directed by this court on 13-03-2026. [5] The learned Addl. AG appearing for the respondent No. 1 submitted that the proposal for complying with the earlier direction given by this court in respect of the petitioner has been put up for approval by the State Cabinet as the same is required under law and that the proposal is listed as Agenda No. 5 of the State Cabinet Memo. The learned Addl. AG further submitted that the State Cabinet will duly consider the said Agenda No. 5 and gave its approval. Thereafter the respondent No. 1 will require atleast four weeks’ time to enable him to submit compliance report. The learned Addl. AG, accordingly, prays for granting four weeks’ time from today so as to enable the respondent No. 1 to submit compliance report. The learned Addl. AG also prayed on behalf of the respondent No. 1 for dispensing his personal appearance before this court. [6] Recording the submission made by the learned Addl. AG on behalf of the respondent No. 1, four weeks’ further time from today is -3- MC(Cont. Case (C)) No. 30 of 2026 Contd…/- hereby granted to the respondent No. 1 for submitting compliance report. It is made clear that in the event the respondent No. 1 failed to submit compliance report on or before the next date, appropriate order for initiating contempt proceedings against him will be passed without further notice. [7] The personal appearance of the respondent No. 1 is hereby dispensed with and the connected MC(Cont. Case (C)) No. 67 of 2025, accordingly, stands disposed of. List this case again on 08-06-2026.
