ORAL ORDER
1. Learned AGA accepts notice for respondents.
2. The Petitioner is before this Court seeking the following reliefs: a. Issue writ of certiorari or any other appropriate writ quashing the impugned order dated 21.05.2026 bearing No. f¥ÉÆÃPÀ,PÉfJ¥sï/UÀr¥ÁgÀÄ/13/2026-27 passed by Respondent No.2 against the Petitioner who has been externed from the limits of Kolar Gold Fields to limits of Tumkur Police Station from 21.05.2026 to 20.05.2027 produced as ANNEXURE-A;
b. Pass any other or further orders as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice and equity.

The grievance of the petitioner is that though a notice had been issued on 12.05.2026 calling upon the petitioner to appear before respondent No.2 on 19.05.2026, no details of any allegations had been provided to the petitioner and on 19.05.2026 when the petitioner appeared before respondent No.2 and sought for details, nothing was made available.

However, respondent No.2, vide its order dated 21.05.2026 has passed an order of externment in respect to the petitioner.
4. A perusal of the papers would firstly indicate that the allegations made against the petitioner have not been made known to the petitioner. Secondly, the externment
order has been passed by the Superintendent of Police, who is not an Executive Magistrate. On both grounds, the impugned order is not sustainable. As such, this Court passes the following;
ORDER i. The writ petition is allowed. ii. A certiorari is issued, the
order dated 21.05.2026 bearing No.f¥ÉÆÃPÀ, PÉfJ¥sï/UÀr¥ÁgÀÄ/13/ 2026-27 passed by Respondent No.2 at Annexure-A is set aside. iii. Liberty is, however, reserved to the concerned officer to issue appropriate notice including all allegations and copies of documents that may be required and for the concerned authority to take necessary action.
