Mr. Dilip Kuma Maiti Ms. Maitryee Maity … For the petitioner 1. The father of the petitioner was serving as an Assistant Teacher in a school. He died-in-harness on 9th November, 2022. Immediately thereafter on 14th November, 2022, the widow of the teacher applied for providing appointment to the petitioner on compassionate ground. 2. The Teacher-in-Charge of the school, in September, 2024, forwarded all papers in support of the petitioner’s prayer for appointment in the died-in- harness category. The District Inspector of Schools (Secondary Education), Nadia is yet to dispose of the application made by the petitioner. 3. None represents the respondents. 4. It appears that the matter relates to appointment in the died-in-harness category. The District Inspector of Schools (Secondary Education), Nadia ought to take a prompt decision in this regard on urgent basis as the matter relates to the livelihood of 2 the family members of the deceased teacher. The District Inspector of Schools ought not to sit tight over the matter and delay in consideration of the petitioner’s prayer. 5. In view of the above, the instant writ petition stands disposed of by directing the District Inspector of Schools (Secondary Education), Nadia to take a decision on the petitioner’s application seeking appointment on compassionate ground under the died-in-harness category at the earliest but positively within a period of six weeks from the date of communication of this order. 6. Learned advocate for the petitioner is directed to forward copy of all relevant documents in support of the prayer of the petitioner to the aforesaid respondent at the time of communicating the order of the Court. 7. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court. 8. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities. (Amrita Sinha, J.)
