The petitioner has filed this petition seeking following reliefs:- “10.1 That this Hon'ble Court may kindly be pleased direct the respondents to get the land bearing P.H. No. 00063, part of Khasra 37/9, area 610.7 square meter situated at HIG 3, Sector 3, Shankar Nagar, Raipur, Tehsil & district Raipur, C.G. diverted from agricultural to residential in accordance with the rates which prevailed in the year 1983 and the petitioner may kindly be permitted to pay the land revenue which was payable at the time of entering into the lease deed i.e. in the year 1983, subsequently. 10.2 Any other relief, which this Hon'ble Court deems, fit in the facts and circumstances may also be granted in favour of the petitioner.” 2. Learned counsel appearing for respondents No. 2 to 5 submits that in pursuance of the representations made by the housing board, the State Government has amended Section 59(2) of Chhattisgarh Land Revenue Code and has made necessary substitution whereby Atal Vihar Planning developed by Chhattisgarh Housing Board has been exempted from re- assessment for the diversion of land. That, subsequently, State Government has made a further amendment in the year 2025, whereby in schedule 4 all the lands allotted to housing board has till dated 31.10.2024, has been added, thereby exempting all the 3 lands developed by housing board exempted from re-assessment for the diversion of land. He next submits that the housing board pursuant to the amendment has directed the concerned officers vide letter dated 29.09.2025, to change the use of their lands from agriculture to residential and convert the lease into freehold. 3. Accordingly, at the outset, learned counsel for the petitioner submits that, in view of the notifications dated 04.05.2012 and 22.09.2025, the petitioner intends to submit an appropriate application before the concerned authorities, as pursuant to the said amendments, the petitioner is not liable to pay the requisite fee for reassessment in respect of diversion of land allotted by the Chhattisgarh Housing Board up to 31.10.2024. 4. In view of the aforesaid submission, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to approach the competent authority by way of an appropriate application in accordance with law. It is, however, prayed that liberty may be granted to the petitioner to file a fresh petition, if any exigency arises in future. 5. Prayer is allowed. 6.
