Mr. Krishnendu Bhattacharyya, APP, Ms. Tanushree Kar Petitioners have approached this Court claiming their innocence. Learned advocate appearing for the State has produced the case diary. I have taken into account the materials appearing in the case diary and having regard to the medical opinion, I am of the view that custodial detention of the present petitioners in connection with the instant case is unwarranted. As such, the prayer for anticipatory bail of the petitioners is allowed. Accordingly, in the event of arrest, the petitioners shall be released on bail to the satisfaction of the Arresting Officer on such terms and conditions as he deems fit and proper subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to 2 Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Since the investigation of the case is still in progress, the petitioners shall make themselves available as and when called for by the Investigating Officer of the case. Mr. Krishnendu Bhattacharyya, learned APP along with Ms. Tanushree Kar, learned advocate is directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities. The application for anticipatory bail, being CRM (A) 2248 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
