Learned advocate appearing for the petitioner submits that the prosecution case although initiated against an individual with whom the victim had left but subsequently the petitioner was implicated as there were accusations that the petitioner had sold the victim at Bihar.
Learned advocate for the State has produced the case diary.
I have taken into account the statement of the victim as also the charge-sheet where another accused, namely, Intajul Mondal was not charge-sheeted.
Having considered the locus of the present petitioner and
2 there are no other allegations except that the petitioner was left at Bihar at a particular residence, I am of the opinion that so far as the complicity of the present petitioner is concerned as charge-sheet has already been submitted, her custodial detention may not be warranted. As such the prayer for anticipatory bail of the petitioner is allowed.
Accordingly, in the event of arrest, the petitioner, namely, Pratima @ Protima Sarkar shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks.
Thus, CRM(A)967 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
