27TH JULY, 2026 Item no.D/L 56 Court No. 24 Pradip, A.R.(Ct.) In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side Case No. WPA 941 of 2024 In the matter of: Dr. Kamlesh @ Kamalesh Jain …. Petitioner VS. The State of West Bengal & Ors. ….Respondents For the Petitioner: Mr. K.D. Poddar Mr. Amit Kr. Dutta ….Advocates For the State: Mr. Lokenath Chatterjee Ms. Mary Datta Ms. Sneha Chatterjee ….Advocates 1. The petitioner claim that the gratuity amount paid to him at a delayed point of time ought to have been compensated by way of ‘up to date interest’. 2. It appears that the petitioner filed an application for contempt being CPAN 788 of 2017 arising out of WPA 3158 of 2016 which stood disposed of on 9th April, 2021 whereby the prayer of the petitioner for grant of up to date interest was disallowed by the Court. 3. The instant writ petition has been filed praying for the same relief. 4. The Court is of the opinion that if the petitioner was aggrieved by the order passed on 9th April, 2021 in the contempt, then he ought to have approached the Hon’ble Appeal Court challenging the same. 5. Once a relief is disallowed by a coordinate Bench, the same prayer cannot be appreciated by a subsequent Bench. 6. In view of the above, no relief can be granted to the petitioner in the instant writ petition. The writ petition fails and is hereby dismissed. Page 2 7.
