JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 and 2 in Crime No.115/2026 registered by Hennur Police Station, Bengaluru City for the offences punishable under Section 115(2), 118(1) read with Section 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.115/2026 registered by Hennur Police Station, Bengaluru City for the aforesaid offences against the petitioners herein, based on the first information dated 06.03.2026 received from Basavaraju, who is the alleged victim in the present case. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.25325/2026 before the - 3 - HC-KAR CNR: KAHC010392752026 NC: 2026:KHC:37681 CRL.P No. 8229 of 2026 jurisdictional Sessions Court, which was rejected on 21.04.2026. Therefore, they are before this Court. 4. The petitioners herein are husband and wife. In respect of the alleged incident that took place on 06.03.2026, a case and counter-case has been registered by Hennur Police Station, Bengaluru in Crime No.114/2026 and Crime No.115/2026. It is not in dispute that the victim in Crime No.115/2026 has suffered only simple injuries in the incident in question. Investigation of the case is already completed and charge sheet is filed. 5. Under these circumstances, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following : O R D E R The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.115/2026 registered by Hennur Police Station, Bengaluru City for the offences punishable under Section 115(2), 118(1) - 4 - HC-KAR CNR: KAHC010392752026 NC: 2026:KHC:37681 CRL.P No. 8229 of 2026 read with Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with one surety for the likesum to the satisfaction of the investigating officer. b) Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. c) Petitioners shall not tamper with the prosecution witnesses and they shall co- operate with the police for investigation and appear before them whenever called upon. d) Petitioners shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE AMM, List No.: 1 Sl No.: 38
