JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in Crime No.121/2026 registered by Gowribidenur Rural Police Station, Chickballapura, for the offences punishable under Sections 329(3), 351(2), 352, 319(2), 318(4) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023, is before this Court in this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking anticipatory bail. 2. Heard learned counsel appearing for the parties. 3. FIR in Crime No.121/2026 was registered by Gowribidanur Rural Police Station, Chickballapura, for the aforesaid offences against the petitioner and others, based on the first information dated 18.04.2026 received from Ahamad - 3 - HC-KAR CNR: KAHC010402382026 NC: 2026:KHC:37734 CRL.P No. 8420 of 2026 Shareef, son of late M. G. Shareef. Apprehending arrest in the said case, the petitioner had filed Crl.Mis.No.229/2026 before the jurisdictional Sessions Court, which was rejected on 16.05.2026. Therefore, the petitioner is before this Court. 4. Perusal of the averments found in the first information dated 18.04.2026 would go to show that the first informant had purchased the property bearing Survey No.233, measuring 4 acres 38 guntas and 0.02 guntas of karab, situated at Gilakunta Village, Nagaragare Hobli, Gowribidanur Taluk, Chikkaballapura District, under a registered sale deed dated 12.09.2011 from one Venkataravanaiah for valid sale consideration. Accused persons herein had created a fraudulent sale deed in respect of the said property and the petitioner herein allegedly had impersonated the first informant. The photograph of accused No.1 is undisputedly found in the concocted sale deed that was created by the accused persons and therefore it is apparent that he had actively participated in the execution of the fraudulent document in respect of the property belonging to the first informant. Under these circumstances, his custodial interrogation becomes necessary - 4 - HC-KAR CNR: KAHC010402382026 NC: 2026:KHC:37734 CRL.P No. 8420 of 2026 to find out the involvement of the other persons who had aided the accused named in the FIR for the purpose of execution of the fraudulent document.
